Before the law change if for example the wife filed for bankruptcy they would only take her income into account to see which Chapter she would qualify for. And in many cases the debtor’s income would qualify them for a Chapter 7. However now they take into account the total monthly household income, including the husbands as well. This tips many people to qualifying for the Chapter 13 repayment process, which is no where near as attractive as the 7.

This situation leaves debtors looking for alternatives to filing for bankruptcy. One of the best alternatives is debt settlement. This process is somewhat similar to a Chapter 13, except you are not going through the court system to pay back your creditors at the reduced amount. Instead you are negotiating a settlement amount with the creditor directly. The advantage here is you have control over what you pay back, plus it is not made a public matter. Where as for the rest of your life bankruptcy is made a public record. Plus in many cases you can actually save more money going through a debt settlement process.
